Real Estate Litigation and Arbitration
- Judgment in bench trial for Dallas real estate developers suing Kansas law firm tenant in dispute over calculation of rental rate on renewal of lease. No. 00 1121-MLB; Argora Properties, L.P., a Texas limited Partnership v. Foulston & Siefkin, L.L.P.
- Represented plaintiffs in claims of breach of real estate joint venture and fraud. Jury verdict and judgment for plaintiffs for $800,000. No. 82-5813; Williams and Leggett v. Reunion Enterprise, Inc.; 298th District Court, Dallas County, Texas.
- Represented defendant builder against claims for buy-sell agreement breach, business torts, and DTPA. The dispute involved a 1,000 acre tract in Harris County, Texas. Favorable settlement for builder. No. 86-24211; Gertner, Aron & Ledet Investments v. Gemcraft Inc.; 55th District Court, Harris County, Texas.
- Confidential, multi-million dollar settlement for client in real estate partnership dispute.
- Represented homeowner in dispute with builder involving mold, foundation, and drainage issues in multi-million dollar Dallas County residence. Asserted claims for fraud, misrepresentation, and recission. Defeated builder’s motion to abate or dismiss pursuant to TRCA and TRCLA and defeated subsequent mandamus petition. To our knowledge, this was first case involving claims related to residential construction that was not ordered to first go through the SIRP process.
- Co counsel for plaintiffs in action involving mold and construction defects in residence and claims against insurer. Damages claimed in excess of $3 million. Confidential settlements. No. 02-00527; Peter and Gail Loeb v. Raymond Oppel and Susan Oppel and Chubb Lloyds Insurance Company of Texas; 192nd Judicial District Court, Dallas County, Texas.
- Represented defendants and counter plaintiffs in claims involving breach of stock agreement, fiduciary duties, and fraud involving foreign time-share investment. Favorable settlement for client prior to trial. No. 98-248; Criswell Associates, L.L.C. v. Tate and Derrah; 162nd District Court, Dallas County, Texas.
